TERMS AND CONDITIONS

1. Introduction

These rental conditions are part of all business transactions in connection with the rental, brokerage, booking and conclusion and termination of rental agreements for holiday apartments, in the name and for the account of the rental property owner, and the tenant (guest), brokered or leased by BlueHills - Carlos Alvarez Dos Santos, hereinafter referred to as agent.

2. Rental price and additional services

a. The rental price is calculated from the components specified in the invoice and in the rental agreement:

Rental price (room rate)

The rental price applies to the rental property specified in the invoice, the arrival and departure dates specified there, as well as the maximum number of people and number of nights (nights).

The rental price includes the following services: energy costs (heating, electricity, water, etc.), WiFi & TV (if available), waste charges for household waste and consumables (toilet paper, detergent, household paper) in normal household quantities.

The following additional services are not included in the rental price and shown and charged separately in the invoice: Mandatory final cleaning, bed, bath and kitchen linen, additional services (e.g. baby cot, pet fee, etc.), paid additional facilities, such as parking, swimming pool, etc., as well as regional structural taxes per tenant x number of nights.

The equipment features and additional services of the rental property are listed on the corresponding pages of the booking platform.

b. All prices listed include the VAT applicable to the respective components.

c. The total rental price is the sum of all components (rental prices plus additional services) of the invoice/booking confirmation.

3. Conclusion of the rental agreement

a. The tenant must be of legal age and must provide proof of identity (ID card, passport, etc.). Accompanying residents must be registered individually, with first names, last names and date of birth. After completing the booking, these details will be requested via the guest app, email or messenger service.

b. The rental agreement is only concluded upon receipt of payment of at least the first installment of the total rental price shown on the invoice in the broker's bank or payment account.

c. If the agreed first installment of the rental price has not been received by the agent no later than 4 working days from the date of the invoice, the agent has the right to rent the rental property to another person without further notice and without being in any way liable to pay compensation to the tenant. The rental agreement is considered not to have been concluded.

4. Payment terms

a. Unless otherwise stated during the booking process or on the invoice, the agreed total rental price will be paid in 2 installments, usually 50% each, in CHF using the specified payment method to the agent's payment account. In the case of bank transfers, the transfer charges are borne by the tenant.
1. Installment of 50% of the total rental price, due no later than 4 working days from date of invoice/booking confirmation
2nd Rate of 50% of the total rental price, due no later than 14 calendar days before the agreed rental date (check-in date).

b. For bookings made later than 14 calendar days before the start of the rental period (check-in date), 100% of the rental price is due no later than 4 working days from the date of the invoice/booking confirmation.

c. If the first installment is not received on time, no rental agreement is concluded. If the 2nd installment is not received on time, the tenant cannot take over and use the rental property. The entire rental price remains owed. The agent can grant a grace period for payment or she has the right to cancel the rental agreement. See Rental start & cancellation section.

d. Additional services used during the rental period must be paid in cash on site in CHF or must be received by the agent's bank or payment account at the latest during the period of stay. Settlement against any claims made by the tenant is not permitted.

e. Payments via credit cards or electronic means of payment can only be accepted if these are expressly stated on the booking website or invoice.

5. Rental period, rental purpose and terms of use

a. The tenant can take over the rental property on the day the rental starts, at the earliest from 16:00 (check-in time). The guest receives further check-in details before the check-in date via guest app, email, messenger service or another communication channel.

b. On the day of departure, the tenant must have left the rental property no later than 10.00 a.m. (check-out time).

c. The rental property may not be sublet in whole or in part, used commercially or for group or sales events and may only be occupied by the maximum number specified in the invoice and by the persons registered by name and used exclusively for private holiday purposes. The agent has the right to verify compliance with these provisions at any time in an appropriate manner.

d. Different terms of use must be agreed in writing.

6. Start of rental & cancellation conditions

a. If the tenant takes over the rental property late or does not take over at all or does not fully comply with the agreed rental period, the entire rent, including the additional services used, remains owed. The tenant is not entitled to a refund of payments already made, with the exception of additional services not used.

b. Any obstacles to travel (such as traffic congestion, closed roads, closed border crossings, etc.) are the responsibility of the tenant. On arrival, the tenant will inform themselves in good time about the traffic situation through public sources of information. If the tenant is unable to take the agreed vacation, he must inform the agent as early as possible.

c. The cancellation conditions depend on the tariff option selected by the tenant and can be found in the respective booking contract.

d. In the event of a valid cancellation and a refund claim, the tenant is not entitled to reimbursement of costs already incurred by the agent, such as transaction fees for credit card payments or other processing costs incurred. These will be deducted from the refund amount.

e. In the event of repeated or serious violations of the house rules or the rules of the building, the agent reserves the right to expel the tenant from the rental property immediately and without refund of the remaining rental amount.
